Corporate Bankruptcy Hurts Employee’s Most

Bankruptcy has evolved from something that people and businesses were deeply ashamed of a few decades ago, to a seemingly acceptable path to restructuring; towards a more sustainable future. Bankruptcy is so common in corporate America that it is referred to by some as an acceptable and necessary business tool.
This bothers me on a number of levels, but mainly because corporate bankruptcies hurt the humble employee the most. The laws are supposedly designed to help the company stay in business, and continue to provide jobs. But at what cost to those employees?
When a company declares bankruptcy, they are essentially admitting to the world that they failed to compete. Their business model was flawed, they were poorly managed, and they simply did not organize their resources appropriately to meet their consumer needs.
Given this failure, it shocks me, that bankruptcy laws are designed to allow management to get together with their bankers. They essentially protect each other. Management is obsessed with holding on to power. The bankers are obsessed with avoiding a loss.
The bankruptcy produces a document called first-day-orders. This is a blueprint for guiding the organization towards future prosperity. But this is essentially drafted by the existing company management, and their bankers. Do you see any conflict of interest emerging here?
Bankers are given super-priority claims to the money they have loaned the company. Even before employee pension fund obligations. This is absurd. Surely if they loaned money to an enterprise that failed, they deserve to lose their money.
Management generally rewards itself with large bonuses, after declaring failure, paying off their bankers, shafting the employees, and finally re-emerging with a vastly smaller company. This is ridiculous.
The humble employee pays the highest price. Assuming there is even a job to return to after restructuring they have likely given up pay, working conditions, healthcare benefits, and pension benefits.
This is exactly what happened at United Airlines in 2002 after they filed for chapter 11 bankruptcy protections. The CEO received bonuses, and was entitled to the full retirement package. The banker’s enjoyed super-priority claims over company assets to cover their loans. Meanwhile, the employees lost wages, working conditions, healthcare benefits, and a 30% reduction in pension benefits.
An adjustment like this would force a serious re-evaluation of retirement plans. For most people, it would require additional years in the workforce before retirement could even be considered a real possibility.
Employees of General Motors, which recently went through bankruptcy proceedings, also had to give up significant healthcare benefits, and life insurance benefits. Entering bankruptcy, it was the objective to reduce retiree obligations by two-thirds. That’s a massive cut.
The warning to all of us here is that we must do everything possible not to fall victim to corporate restructuring. Save all you can, outside of your expected pension plan, because you never know when poor management, or a terrible economy, will force your employer to file bankruptcy. Always plan for the worst possible outcome.
It’s a competitive world and it’s quite possible that the traditional American system of benefits is uncompetitive, and unsustainable in the global market place. The tragedy of adjusting to a more sustainable system is that the employee suffers the most.
Jobs I’ve Had
I’ve always worked. From the time I was young, I knew that, if I wanted to feed my G.I. Joe addiction, I needed a way to make money.
So I got a job.
I was the only kid in first grade earning a steady paycheck.
In the years since, I’ve had a dozen or so jobs at 10 different companies. The question has been asked, so this post is my answer: these are all of the jobs I’ve ever held.
- Paper route. Starting at age 6, I split a paper route with my brother. Initially, I made about $6 per month, which was enough for 1 G.I. Joe.
- Farm hand. I spent a couple of summers in junior high and high school doing odd farm jobs outside of my home town.
- Dishwasher. Starting in 9th grade, I gave up a study hall to work in the school cafeteria, serving food and washing dishes. It paid minimum wage for 1 hour per school day.
- Construction. For a couple of summers, I worked for my dad’s construction company. He was easily the hardest boss I’ve ever had, which was great preparation for the rest of my working life. The drunk bar owner who didn’t allow his employees a lunch break and got upset if they sat down on a smoke break was nothing by comparison. Thanks, Dad. Every employer since has been astonished by my work ethic, even when I’m having an off day.
- Dishwasher, take 2. Sixteen years old, thumped by the wisdom of “If you want a car, get a job to pay for it.” So I did. It paid a bit over minimum wage and gave me my first “Who the heck is FICA and why is he robbing me?” moment. I eventually got promoted to cook, which came with better pay, worse hours, and more opportunities to flirt with waitresses. It was grand.
- Palletizer. This is a fancy way of saying I stood at the end of a conveyor belt, picked up the 50 pound bags of powder as they came down the line, and stacked them neatly on a pallet. Rinse and repeat. 1500 times per night. By the time I left this job, I had arms that would make Popeye cry.
- Cook, take 2. I held this job at the same time as the palletizer position. I’d work 8 hours stacking pallets, then head to job #2, 5 miles away. My car was broken at the time, so I rode my bike. In the winter. In Minnesota. I was working 14-16 hour days, lifting a total of 75,000 pounds, biking 10 miles per day. I was in great shape and tough. I wasn’t tough enough, though. I could only maintain this schedule for a couple of months.
- Machine operator. During my stint with this company, I’d put a little piece of metal into a great big machine, push a button, then spend 15-20 minutes listening to the great big machine carve the little piece of metal into something worth selling. This was about when I started shopping for books based primarily on thickness. One night, I read The Stand in my spare time. I’d also pass the night by burning scrap magnesium flakes in the parking lot. What can I say? Twelve hour graveyard shifts with 3 hours of actual work are boring. I left a few months after my son was born, because I was missing too much of my family time. I took a 30% pay-cut, before overtime, to be with my wife and kid.
- Debt collector. I worked my way through college by collecting on defaulted student loans. I firmly believe that we should all live up to our obligations and responsibilities, including paying your bills, so I didn’t have a moral dilemma with the work. There are some bad apples, but I don’t see collectors as pariahs.
- Systems Administrator. After I graduated college, I got promoted and spent the rest of my time there managing the collection and auto-dialer software and the hodge-podge of other applications we needed, some of which, I wrote.
- Software engineer. This is where I am now. I’ve written a medium-scale ecommerce application that handles the online sales for quite a few companies, mostly in the B2B arena. The job also includes a large chunk of training, management, and even sales. I don’t particularly enjoy sales, but a programmer geek who can manage other programmers, coordinate with sales & marketing, and talk to customers during a sales demo is a rare bird.
To recap: I’m 32 and I’ve had 1 month out of the last 26 years that didn’t come with a paycheck. I’ve worked for 10 different companies and I start the job before this one when I was 20.

Stand Up For Yourself
Monday night, my son was struggling to get all of his homework done before bed. He had a 6 page packet of work from his advanced math class that he was supposed to have done over the weekend.
When I asked him why he hadn’t done it, he told me he forgot about it.
I wasn’t happy.
We’ve had a lot of conversations about responsibility and planning over the years. He knows better.
Cue Dad Lecture #26.
Towards the end, when I’m building up this rocking crescendo about how what he does now will affect him for the rest of his life, I stopped.
“Buddy, weren’t you sick on Friday?”
He didn’t get his weekend homework until Monday. Of course he didn’t do it over the weekend.
Dad Lecture #26 immediately transitioned to Ad Hoc Lecture #4, titled “Why did you let me chew you out for something you didn’t do?”
I’ve always tried to raise my kids to be independent. I’ve never stifled asking questions, and I am willing to explain my decisions to them, even if they don’t stand a chance of winning the appeal. As frustrating as independent, strong-willed children can be, I know it will serve them well as adults.
Now I’m trying to figure out why that fell apart on Monday. I wasn’t yelling at him and he doesn’t think I was. Sometimes, the perception of who’s yelling differs depending on which side of my loud voice you are on.
He doesn’t know why he sat back at took the lecture instead of explaining what happened. He apparently forgot that he was given that homework just a few hours before.
My question to all of you is how can I make my kid behave and obey when necessary, but still have enough backbone to stand up for himself when he’s not wrong? And know when each is necessary.
Can I Sell My Lottery Payments for a Lump Sum?

Winning the lottery is everyone’s dream. You hit the lotto, cash in your ticket and kiss all your troubles goodbye, right? Actually, that might not be true. Just look at the number of lottery winners who’ve ended up worse off than they were before they hit it big. There are several problems here. One problem is that people often spend their money unwisely, without learning how to manage it properly. Lottery annuity payments were designed to help with this. However, those annuity payments might not actually be enough to make a significant difference in your life. If that’s the case, you might be wondering if you can sell your payments for a lump sum. The answer is, yes, you can. But there’s a catch. Actually, there are a couple of catches.
Buyers Matter
First, let’s talk about buyers. They’re the ones who’ll be paying you a lump sum for your lottery payments. Now, you can’t expect a buyer to offer the full amount you’re owed from the lottery, but you should be able to expect a significant percentage of the winnings. That’s not the case with many buyers. They recognize your desperation and have no qualms about taking advantage of your situation. That’s not true for all buyers, though. You need to recognize qualified buyers from those better left alone. Obviously, that’s tough to do on your own. Most people have never been in the position of having to sell lottery payments before, and it’s easy to get lost in a world with which you’re not familiar.
Sell Only Part of It
Another important consideration is whether you need to sell all of your lottery winnings or only a percentage of them. You can easily sell just a specific portion of your winnings, enough to cover your immediate needs, and retain the remainder as regular ongoing payments. This ensures that you have the money you need right now, as well as a financial cushion for the future.
Work with a Go-Between
The ideal solution to your quandary is to work with a firm that acts as a go-between. The company will vet and investigate buyers, ensuring that you only have the cream of the crop to choose from. Not only that, but working with a reputable firm will also ensure that you get the highest percentage possible of your winnings, rather than leaving you with a mere pittance.
Of course, not all such firms are the same, and you need to recognize a reputable company. Look for a firm that’s been in business for a number of years – one with an established reputation and a list of satisfied clients. Second, make sure the company doesn’t work for the buyers – the firm should work for you, the seller. This ensures there’s no conflict of interest. A company that works on behalf of the buyer has no incentive to go above and beyond to ensure you get a fair deal. One that works for you certainly does.
Jules Bianchi – Is a high-risk career worth the money?
The violent crash at the Japanese Grand Prix calls into question whether the life of a racing driver is worth the money. These men are paid handsomely for their efforts, but they could die at any minute on the track. It is best for people to remember what it is like to do this job, but it is also wise for people to think about what it means to the driver who do this job.
The Risk
The risk in F1 is high, and Jules Bianchi saw that firsthand when he was injured so badly that he had to be rushed to the hospital for emergency surgery for head injuries. His crash was so violent that is stopped the race. People crash all the time, but this crash stopped the race. Bianchi is no doubt a millionaire, but people would wonder why he would risk it all just to drive a car quickly.
Every one of the drivers on the circuit does not have an imagination. People like Bianchi or Schumacher or Alonso or Vettel do not think for a second about what could happen when they crash. These men only think about winning races. They only think about doing their best. They know the risks, but they do not sit around thinking about it.
The Pay
F1 drivers are paid extremely well, and they participate in the most glamorous sport in the world. They do something that is more difficult than any other sport, and it is difficult, but they live the lives of rock stars. They know this fame will be short-lived, but they drive regardless.
Jules Bianchi knew the risks when he got in the car. He is being paid extremely well to do his job, and it is worth it to him. People around the world may not have the bravery or raw talent to become a great driver, but he does. He has a ride on the Formula One World Championship circuit. He has to take his car to the limit if he wants to do well.
The Alternatives
Someone like Jules Bianchi does not have to leave the sport even if he is injured badly. Many drivers will get back in the car, but other drivers will simply move to other parts of the sport. Drivers can become owners, engineers and test drivers. These drivers can become test drivers and designers for auto makers, and they can commentate on the sport they love.
They do not want to go to these alternatives because they cannot drive forever. There is also a Masters Series coming up for F1 where drivers who are over 45 can ride. These men get back in the car at high risk to their lives because it is what they love. When someone is this passionate about something, they must keep doing it.
