5 Ds of Identity Theft
Identity theft is, at its most basic level, the act of using someone else’s identity or credit without permission. From a stolen credit card to a forged phone bill in Moscow, it all involves your good money paying for the bad habits of another. Thankfully, there are ways to reduce the odds of having your identity stolen. LTC David Grossman reviews the “5 Ds of Survival” in his seminars and books. Today, I bring you the 5 Ds of Identity Theft.
In the words of the master, “Denial has no survival value.” Denying the possibility of identity theft will not keep it from happening. You have to take steps to keep yourself safe. “It could never happen to me” is not a valid defense mechanism in any situation, financial or otherwise.
Deterrence means keeping the information away from identity thieves. The harder it is for the criminals to get your information, the more likely it is that they will move on to an easier target. And yes, a kid stealing Grandma’s credit card is a criminal and needs to be treated as such.
- Some people use a shredder, but not me. I have a fire pit that catches all of my personal documents. I’d like to see an thief get my social security number from the ashes in the bottom of the pit.
- Don’t carry your social security card. If you lose your wallet, your driver’s license and social security card contain all of the information needed to steal your identity. Keep it locked up at home and don’t give the number out unless absolutely necessary.
- Don’t use stupid passwords. Anything listed on yourFacebook profile or otherwise available on Google in association with your name is a stupid password. Don’t make life easy for the people looking to screw you. Your birthdate, maiden name, and “password” all qualify as stupid passwords. Use KeePass to securely generate and store your passwords.
- Lock up your personal information. I throw two large parties every year. Purses and wallets get stored in a locked bedroom, so nobody can grab them. That was a lesson learned the hard way. If there’s someone in your home you don’t trust absolutely, lock up anything that can be used against you.
- Don’t release personal information to anyone, for any reason, unless you have initiated the contact. Don’t give a credit card number to a telemarketer. Don’t give a spammer your personal information. It’s your privacy, use it.
- Don’t click anything in an email. If it’s a company you have a relationship with, type the address in your browser by hand.
Detection is up to you. Some credit card companies will alert you to suspicious purchases, but you can’t rely on it. I was once called because I went to the gas station and Best Buy, which is apparently a common pattern for a stolen credit card.
- Examine your credit card statements. If there’s a purchase you don’t recognize, find out what it is.
- Watch for bills to arrive as expected. You do know when you pay the gas bill every month, right?
- Watch for unexpected bills to arrive. If you get a statement for a credit card you don’t have, it’s a problem.
- Check your credit report three times per year. AnnualCreditReport.com will let you see each of the three major credit reports each year. Space them out so you see your report every 4 months.
Defending your identity happens after you’ve detected a theft. This involves getting your credit and sometimes, your money, back.
- File a fraud report with the credit bureaus. This will force potential creditor to follow certain procedures before opening new credit accounts for your identity, including calling your cell phone, if you choose. Stop the identity theft in its tracks.
- Close the fraudulent accounts. Don’t leave them open for abuse.
- File a police report and report the fraud to the FTC at ftc.gov/idtheft . This may or may not help catch the criminal, but without it, there will never be a punishment. Make stealing your identity an expensive proposition. Hopefully, 1o years of his life will be wasted in jail in return for the theft.
Destroy. Unfortunately, fraud and identity theft are not yet capital crimes. Maybe someday.
Deter, detect, defend. These are the secrets to avoiding, and recovering from, identity theft.
Debt Scams
When you are up to your eyeballs in debt, praying for a step-stool, sometimes life–more accurately, con-artists–try to trip you when you are vulnerable and look for a solution. They aren’t muggers on the street. They come at you wearing ties, invite you to a real office, with real furniture and a real nameplate on a real desk. They are a real company, but that doesn’t mean they aren’t trying to scam you out of the little money you have left to put towards your debt.
Yes, I am talking about debt management scams. These scams come in 4 main varieties.
Debt Settlement companies instruct you to stop paying your bills completely and send them the money instead to be placed in a settlement fund. When your creditors get desperate enough, they will be willing to settle for pennies on the dollar.
In theory, this can be a good strategy for some debtors. Unfortunately, it has some drawbacks, even if the company is legitimate. They tend to charge high fees as a percentage of your deposits. Some take another fee when a settlement is accepted. The entire time you are building your settlement fund, your credit rating is sinking, leaving you open to being sued or garnished. The bad companies take the fund and run, while even the good companies can’t guarantee your creditors will play ball.
Ultimately, they aren’t doing anything you can’t easily do yourself. If you want to go the settlement route, stop making your payments and funnel the money into a savings account that you will use to offer settlements from. It takes discipline, but there is no upside to paying someone else for the same function.
Debt Management plans are used when you owe more than you can afford to pay. These companies work with your creditors to adjust interest rates and minimum payments and they try to get some fees waived for you.
A good company will work with you and your creditors to make sure everyone is working together towards the goal of eliminating the debt. A bad company will tell you they are working with your creditors while ignoring any contact from the creditor. They’ll tell you the creditor isn’t willing to negotiate while never stepping up to the negotiation table. Another trick is to offer the creditor a set payment, with a “take it or leave it” clause. Any input from the creditor is interpreted as a refusal to participate. This, coupled with high fees paid by the debtor, make debt management firms a risky proposition. Most states require the firms to be licensed. Check to make sure they are before giving them any information.
Debt/Credit Counseling companies work with you to establish a budget and eliminate expenses; in effect, they are training you to be in control of your finances. They are often organized as a nonprofit, but not always.
Some–the sleazy ones–lie about what they are doing, or attempt to misconstrue what you are agreeing too. Be careful not to use your home as collateral to consolidate unsecured debt and don’t walk into a Chapter 13 bankruptcy without that being your intention. Both of those are common debt counseling scams. If the company isn’t able to provide all of the details of a transaction–company name, address, licensing information–or they aren’t willing to spend as much time as necessary explaining the details of the transaction, walk away. This is your life, you are in charge of it. Don’t let anyone bully or prod you into signing something you aren’t comfortable with.

There are two legal methods to repair your credit. First, stop generating bad credit. Make your payments on time and eventually, the bad items will fall off. Second, write letters disputing the actual incorrect items on your credit report. There are no quick fixes, and anybody telling you different is flirting with a jail sentence, possibly yours.
How do you avoid the scammers?
- Be skeptical. If it looks to good to be true, it probably is. There is no such thing as a magic wand to fix your credit and make your debt disappear. Bankruptcy + 10 years of your life is the closest thing to magic credit repair in this world.
- Only use a legitimate credit counselor. Verify them through the Better Business Bureau and the National Foundation for Credit Counseling (1-800-388-2227 or www.nfcc.org)
- Check the license. Most states require credit and debt counselors to be licensed. If they’re not, run away and report them.
- Read the find print. Don’t sign anything you don’t understand. Like every other piece of your financial life, own the transaction. Know what your are doing, or don’t do it.
- Are they willing to work with you? If they’ve got a generic plan that doesn’t account for your specific situation, they are probably a con. At the very least, they are a worthless company and a waste of both time and money.
- Are they willing to work with your creditors? If not, they won’t be accomplishing anything for you.
- How much do they cost? Higher fees may not be an indicator of a scam, but call around and find out if they are in the right ballpark. Triple or quadruple the going rate is a sign of someone who will disappear late one night, with your hopes, dreams and savings in tow.
- Above all else, trust your gut. If it doesn’t feel right, it probably isn’t. There is nothing a counselor can do that can’t wait a few days while you check them out.
There is no magic bullet to kill debt. You’re not fighting a werewolf, you’re fighting a lifetime of bad or unfortunate choices and circumstances. It’s important to keep a realistic outcome in mind.

Fixing Your Credit Report
Sometimes, negative things appear on your credit report. Usually, they do a good job of maintaining

If either of these situations are true, you’ll want to correct your credit report, making yourself eligible for lower rates on future credit and, occasionally, lowering the cost of things like auto insurance.
If you throw “credit repair” into Google, you get 18 million hits. Most of those are either outright scams or hopelessly optimistic about what they can accomplish. As I said once before:

There are ways to avoid the scammers.
- Avoid advance-fee credit repair. If they are any good, you will pay for results, not intentions. If they charge beforehand, they are already breaking the law.
- If they insist they can erase the accurate, but negative information, run away.
- If they tell you to dispute everything negative, even the accurate information, run away.
- If they tell you to create a new credit identity, don’t just run, report them. It’s a felony.
Legally, you cannot get valid information removed from your credit report. Anyone who tells you differently is advocating a crime. However, according to the Fair Credit Reporting Act (FCRA), you are entitled dispute incorrect records.
To verify the accuracy of your credit report, you need to see it. You can get a free report if your credit is used to deny you for something. This is known as an “adverse action” . You have 60 days from the denial to request the report. You can also get one free report from each of the major credit bureaus each year. I space out these requests so I see my credit report every 4 months.
If there is inaccurate information on your report, dispute it in writing. Send a letter to the credit bureau that is reporting the error. Explain the problem and politely demand an investigation. They will contact the creditor, who usually has 30 days to respond. In the meantime, send a dispute letter to the creditor, along with proof of the inaccuracy. If the investigation does not go your way, the creditor will have to report the dispute status to the credit bureaus in the future.
If the negative items are accurate, there is only one way to get it off of your report legally: Wait. Most negative information can only be reported for 7 years, while a bankruptcy will be reported for 10.
Another way to build your credit in the face of negative credit is to start building good credit to overshadow the bad. Get a credit card. Your first credit card from the bottom of the debt-barrel will probably be a gas card or a store-branded credit card. That’s fine. The main consideration is are low or nonexistent fees. Don’t accept application fees, activation fees, fees for carrying a balance or fees for not carrying a balance. Annual fees are becoming a fact of life, so look for low fees. The interest rate does not matter. You will be paying this card off immediately, meaning no less often that every two weeks. Make sure every penny is paid during the grace period, and make sure your card comes with a grace period. Some don’t. Those are bad cards to get.
There are no quick fixes for bad credit, just good new habits and time.
One Year Later….
In April of 2009, I told my wife we were either going to straighten out our finances or file bankruptcy. At that time, we had $90,394 in total debt, including $30,000 in credit card debt. It hasn’t been easy, but we are working out way out of that hole. Since then, we have paid down more than $30,000. That’s not $30,000 in payments, but $30,000 less debt. We are now less than $60,000 in debt. We have entirely stopped accumulating more and I don’t remember the last time we carried a new balance on a card or had to use our overdraft protection. Next month, my car will be paid off, 10 months early.
Given my new-found fanaticism, I spent the next 6 months or so evangelizing about our debt repayment. Eventually, I decided to share my thoughts and progress with the world and launched this site on December 1, 2009. Today is my anniversary.

How to Complain – The Squeaky Wheel Gets the Grease
Have you ever been screwed by a company? Have they sent you the wrong item, or an empty box, or left your order backordered for so long that you can’t even dispute it with your credit card company any more?
What can you do?
I know you’ve heard the phrase, “The squeaky wheel gets the grease.” That means, he whines loudest, gets the most. The thing is, you have to whine effectively, or you’ll just get round-filed.
Targeting Subsystems On
Who you complain to matters more than what you complain about. The clerk at your local big-box retailer isn’t going to refund your online purchase. You need to complain to someone who can make a decision to help you. First, find the customer service email address. Next, if you are complaining about a recurring service, find the retention department’s email address. Finally, find the email address for absolutely everybody Vice-President or above for that company, including the board of directors. Go to their website, find the email for some PR drone and figure out the format. First.Last@Company.com or FirstInitial.LastName@Company.com or whatever. Look up the company in Google Finance and translate everyone’s name into the email format. You might not have the perfect list, but it should be close.
Target Locked On
Now that you know who you are about to blast, what are you going to say? A few things to include are:
- Your contact information. If they can’t get back to you, they can’t make it up to you.
- Details of the problem. Include the date of purchase, date of delivery, and a detailed description of what actually went wrong.
- Scanned copies of receipts.
- Any names of anybody you’ve had to deal with, either in the original transaction or when the problem occurred, if you have the names.
Engage!
What to say, what to say?
- Don’t be abusive. It’s okay to be angry, and it’s okay to let them know your are angry, but swearing or threatening their lives will–at best–only get you ignored. Worst case, threats are illegal and they can pass your email along to the police.
- Stay brief. It doesn’t matter that your daddy took you to Starbucks to use their free wi-fi when you were just three years old. Don’t talk about that time the aliens abducted you or how sad you are that they never call like they promised they would. Keep to the point. “This is who I am. This is what happened. This is what I want you to do about it.”
Send that sucker out. If you feeling particularly perturbed, send a CC to your state’s Attorney General and any possibly related regulatory agencies. I tend to save this step for round 2.
